1. Introduction

NowRise ("we," "our," or "us") operates the NowRise mobile application (the "App"), a mental performance training platform designed for competitive athletes. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our App. By accessing or using NowRise, you agree to the terms of this Privacy Policy. If you do not agree with the practices described in this policy, please do not use the App.

We are committed to protecting your privacy and handling your data with transparency and care. This policy applies to all users of the NowRise App available on the Apple App Store.

2. Information We Collect

We collect information that you provide directly to us, as well as certain information that is generated automatically when you use the App.

Account Information

When you create an account, we collect your email address and display name. Authentication is handled through Supabase Auth via passwordless email (magic link/OTP). You may also sign in using Apple Sign In, in which case Apple provides us with your name and email address in accordance with your Apple ID settings. We do not collect or store traditional passwords. Your email address is used to identify your account, enable login, and communicate important service updates.

Usage Data

We collect information about how you interact with the App to improve your experience and our services. This includes:

  • Sessions you have played and completed
  • Duration and frequency of session playback
  • Session types and categories you engage with (e.g., meditation, visualization, breathing)
  • Sport preferences and filter selections

Device and Analytics Information

We use Firebase Analytics and Firebase Crashlytics (provided by Google) to automatically collect certain technical information about your device and app usage, including:

  • Device type and model (e.g., iPhone 17, iPad Pro)
  • Operating system and version (e.g., iOS 18.0)
  • App version number
  • General geographic region (inferred by Firebase Analytics from your IP address — we do not collect precise location data)
  • Crash logs, stack traces, and diagnostic data via Firebase Crashlytics to help us fix bugs and improve stability
  • App interaction events and screen views via Firebase Analytics

Push Notification Tokens

If you enable push notifications, we collect your device token to send you relevant notifications such as session reminders and product updates. You can disable push notifications at any time through your device settings.

User-Created and Progress Data

Personal content and progress data you create within the App is stored on your device and is not transmitted to NowRise servers. This includes:

  • Affirmations you create
  • Reflection journal entries
  • Custom routines
  • Daily progress and streaks
  • Mental training performance levels (MTP) and progression data
  • Profile photos (stored on-device only, never uploaded to NowRise servers)

If you are signed into iCloud on your device, this data may sync across your Apple devices via Apple's iCloud (CloudKit) service. This synchronization is handled entirely by Apple and is subject to Apple's Privacy Policy. NowRise does not have access to your iCloud data. You can manage iCloud sync for NowRise in your device's iCloud settings.

3. How We Use Your Information

We use the information we collect for the following purposes:

Service Delivery

To provide, maintain, and operate the NowRise App, including authenticating your account, streaming audio sessions, and delivering content tailored to your selected sport and preferences.

Improvement and Development

To understand how our users interact with the App so we can improve existing features, develop new content, fix bugs, and optimize performance. Usage data helps us identify which types of sessions are most valuable to athletes and where we should focus our content development efforts.

Communication

To send you important service-related communications, such as account verification emails, security alerts, changes to our terms or policies, and responses to your support inquiries. We may also send occasional product updates about new features or content, from which you can opt out at any time.

Safety and Security

To detect, prevent, and address technical issues, security threats, fraud, or other harmful activity. We may use device and usage information to identify suspicious behavior and protect the integrity of our service and our users.

4. Data Sharing and Disclosure

We do not sell, rent, or trade your personal information to third parties for marketing or advertising purposes. We do not use third-party ad tracking services. We may share your information only in the following limited circumstances:

Service Providers

We work with trusted third-party service providers who assist us in operating the App. These providers have access to your information only to the extent necessary to perform their services and are contractually obligated to protect your data:

  • Supabase - Provides authentication services and database infrastructure for storing account and session data
  • Google Firebase - Provides analytics (Firebase Analytics) and crash reporting (Firebase Crashlytics) to help us understand app usage and improve stability
  • Apple - Distributes the App through the App Store, provides Sign in with Apple authentication, and syncs user data via iCloud (CloudKit) if enabled on your device

Legal Requirements

We may disclose your information if required to do so by law or in response to valid legal requests by public authorities, including to meet national security or law enforcement requirements. We may also disclose information when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

Business Transfers

If NowRise is involved in a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of that transaction. We will notify you via email or a prominent notice in the App of any change in ownership or uses of your personal information, as well as any choices you may have regarding your information.

5. Data Security

We take the security of your personal information seriously and implement industry-standard measures to protect it. Your data is transmitted using TLS (Transport Layer Security) encryption. Authentication is handled via passwordless methods (email magic links and Apple Sign In), eliminating traditional password-related risks. Our backend infrastructure is hosted on Supabase, which provides enterprise-grade security including row-level security policies, encrypted data storage, and regular security audits.

While we strive to use commercially acceptable means to protect your personal information, no method of transmission over the Internet or method of electronic storage is 100% secure. We cannot guarantee the absolute security of your data. If we become aware of a security breach that affects your personal information, we will notify you in accordance with applicable law.

6. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you with our services. If you request deletion of your account, we will delete or anonymize your personal information within 30 days, except where we are required to retain certain information to comply with legal obligations, resolve disputes, or enforce our agreements.

Aggregated, anonymized data that cannot be used to identify you may be retained indefinitely for analytical and product improvement purposes.

7. Children's Privacy

NowRise is not intended for use by children under the age of 13. We do not knowingly collect personal information from children under 13. In compliance with the Children's Online Privacy Protection Act (COPPA), if we become aware that we have inadvertently collected personal information from a child under 13, we will take steps to delete that information as quickly as possible.

8. Your Rights

Depending on your jurisdiction, you may have certain rights regarding your personal information. We respect these rights and will respond to valid requests in a timely manner. Your rights may include:

  • Right to Access - You may request a copy of the personal information we hold about you
  • Right to Correction - You may request that we correct any inaccurate or incomplete personal information
  • Right to Deletion - You may request that we delete your personal information, subject to certain legal exceptions
  • Right to Data Portability - You may request a machine-readable copy of your data
  • Right to Opt Out - You may opt out of non-essential communications at any time

Depending on your location, you may have additional rights under applicable state privacy laws. For example, California residents have rights under the California Consumer Privacy Act (CCPA), and Washington residents have rights under the Washington My Health My Data Act. These may include the right to know what personal information is being collected, the right to request deletion, and the right to non-discrimination for exercising your privacy rights.
